It’s Petition Time! Petition for a Vote

The LLA ad-hoc Municipal Incorporation Organizing Committee, (MIOC) held workshops in September 2013 and has been busy arranging for the next step—a petition to the Frederick County Board of County Commissioners, (BoCC) requesting authorization to pursue the incorporation of Lake Linganore at Eaglehead.

There were many questions that had to be answered before the format of the petition could be finalized…but we are just about there!

In the near future, residents of the Lake Linganore Community that are registered voters will be asked to sign the petition to move the incorporation process forward. We will need the signatures of approximately 2000 registered voters from our community in order to fulfill the petition requirements.

It is critically important to understand that signing the petition does NOT actually CREATE the municipality. It is merely a request to the BoCC to allow the community to continue the process with the writing of a town charter and a referendum vote by the potential residents of the new town. It is the referendum vote that determines if a municipality is created. Every registered voter within the proposed town limits (essentially the same boundaries as the LLA HOA) will be able to cast his or her vote on the matter.

At the FY2015 LLA budget meeting held December 2, 2013, the results of a recent 2013 LLA Reserve Study were discussed. The overall findings of the reserve study empasized that, in order to preserve and maintain the infrastructure and amenities of the LLA, we will need to double our current yearly reserve deposits—from $750k to $1.5 million per year. Of course, doing this would require a major increase in yearly dues. However, we’ve discovered there is another way to possibly fund the $1.5 million annual reserve deposit (recommended in the reserve study), and it happens to be through municipal incorporation:

As an HOA, the LLA does not directly receive any of the MD state income tax paid by its residents. These monies go to Frederick County and the County does not necessarily have to spend these funds in the Lake Linganore area. If we were a town, we would get these funds directly from the state. How much? About $900,000 per year !! As a town we would also get Tax Equity funds from Frederick County to reimburse us for things we provide that would normally be done by the County….principally road maintenance and snow removal. How much? About $190,000 per year. Currently, as an HOA, we are not eligible for any of these funds.

Therefore, as a municipality, we stand to gain direct access and control of nearly $1.1 million that we CANNOT get as an HOA.

In the near future, volunteers from the community will be asking for your signature on the petition for incorporation. The acquiring of nearly $1.1 million as discussed above is just one of the potential benefits to consider when you are asked to sign the petition.
