WestWinds ECC Guideline for
Basketball Hoops
Adopted August
16, 2006, with Procedural Changes Effective January 17, 2007
Supersedes
all previous WW ECC Guidelines for Basketball Hoops
Permanent basketball backboard/hoops
are prohibited within the WestWinds community. For this Guideline, the definition of
permanent is defined as being attached to the exterior of any home/garage or
affixed upon a lot/property.
Portable basketball backboard/hoops may be permitted within WestWinds if
approved and registered by the WW ECC prior to use. Generally, basketball
hoops will not be approved for backyards. However, each request will be
considered on a case-by-case basis.
Registration/Approval
Procedure:
1.
Complete
the WW Basketball Backboard/Hoop Registration Form (see page 2 of this
Guideline)
by providing:
(a)
Resident’s name, address, and phone number;
(b) Equipment description (brand
name and distinguishing characteristics); and
(c) Site plan showing specific location
of where equipment will be used.
2.
Submit
Form to: WestWinds Environmental
Control Committee, P.O. Box 589, New Market, MD 21774. No fee is required.
Review
Process:
The WW ECC
will review the information provided on the Registration Form. The following
factors will be considered in its review:
1.
Location
of proposed hoop. Its use must not
constitute a nuisance to neighbors.
2.
Material
of backboard. Pole must be a dark color
(such as black, brown, or dark
gray) and be
comprised of a maintenance-free material. A clear (see-thru) backboard
is preferable but not mandatory, and is to be
no longer than 50” diagonal.
If approved,
the WW ECC will send the homeowner an approval letter with a registration
sticker, which is to be adhered to the basketball backboard/hoop system.
If
disapproved, the WW ECC will send the homeowner a letter advising of the
disapproval and stating the reason for disapproval.
Conditions
of Approval:
Portable
Basketball Backboard/Hoops approved by the WW ECC:
1.
Must be placed out of view (preferably in the garage) each night as
currently required by the WestWinds Covenants.
2.
Must not be used prior to 9:00 a.m. and after 8:00 p.m. or dusk, seven
days a week.
3.
May not be installed or attached to the home/garage in any manner.
4.
May only be placed and used on
the driveway (or where approved by the ECC), and may not be used
in or left along any of the streets or any common property within the community
at any time during the day or night.
5.
Does not constitute
authorization to encroach or trespass on a neighbor’s property
to retrieve balls or use as a playing field in any way.
6.
Must be
removed (i.e. take it, throw it away, or dispose of it) from the property by
the vacating homeowner when the house is sold.
Note: The location specified on the site plan or
as designated by the WW ECC is the approved location.
Placement
of the equipment elsewhere will be considered a violation.
Any damage
to property caused by players shall be the responsibility of the registrant to
repair.
