Guideline for penalty against one who initiates but does not complete work approved by the ECC within one year:

Prior to return of a compliance deposit the owner of the property must request an inspection of the project by the ECC. If the inspection report states that the construction has been completed as approved a full refund of the money will be made.

The compliance deposit money for new construction of any kind, including but not limited to fences and decks, will be forfeited by one who does not complete construction of any approved and initiated project within 12 months of receiving ECC approval.

Compliance deposit money held for the purpose of new construction of a dwelling is held in Westwinds Properties LLC Compliance Deposit Account. Compliance deposit money for fences and decks will be held in a Westwinds HOA Compliance Deposit Account.
